Patient under house arrest sues to use medical marijuana in New Mexico

In New Mexico, a man under house arrest for drunk driving is suing so he's allowed to use medical marijuana. 

The lawsuit was recently filed in the state district court. According to the lawsuit, Joe Montano had his home serached while under house arrest and authorities found marijuana. He was then put in jail for a month as punishment.

The petition seeks a judge to order the jail to allow him to possess and use his medical marijuana.

Last year, state lawmakers passed a measure that allowed people under house arrest to possess and use medical marijuana.

Despite this law, the corrections facility stated that Community Custody Program inmates are considered in jail custody and medical marijuana use is not allowed in the detention center.
